UAB Acme Europe Privacy Policy

  1. General Provisions

This document (hereinafter referred to as the Privacy Policy) establishes the main principles of collection, processing and storage of your (Customer's) Personal Data by UAB ACME Europe (data are collected in the Register of Legal Entities of the Republic of Lithuania, legal entity code – 301589946, registered office address – Raudondvario road 131B, Lithuania, e-mail address – info@acme.eu (hereinafter referred to as the Company).

The Privacy Policy is intended to protect and defend the Customer's Personal Data from unauthorised use.

In processing the Personal Data, we comply with the Regulation, the Republic of Lithuania Law on Legal Protection of Personal Data, the Republic of Lithuania Law on Electronic Communications, and other directly applicable legislation regulating the protection of Personal Data, as well as with the instructions and recommendations of competent authorities.

  1. Definitions Used in the Privacy Policy

Personal Data’ means any information relating to an identified or identifiable natural person – data subject; an identifiable person is one who can be identified, directly or indirectly, by reference to the relevant data;

Customer’ means any person who orders, purchases or uses our Services, or who has expressed an intention to use, or in any way uses the Company’s services, intends to purchase or purchases the Company’s goods or is otherwise related to the services or goods supplied by the Company.

Processing’ means any operation (including collection, recording, storage, changing, access granting, requesting, transfer, etc.) performed with the Personal Data.

Connection Data’ means the Internet Protocol (IP) address and the Internet service provider used to connect the device to the Internet, the browser type and version, time zone settings, the browser plug-in type and version, the operating system and platform, the connection location, the font encoding, the Uniform Resource Locator (URL), the products you viewed.

Regulation’ means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

  1. Principles of Personal Data Processing

In its activities, the Company is guided by the following main principles of Personal Data processing:

  • Personal Data are collected for explicit and legitimate purposes;
  • Personal Data are processed accurately and fairly;
  • Personal Data are processed lawfully, i.e. only in the cases where:
    1. the data subject gives his/her consent, e.g. to the receipt of promotional information;
    2. a contract, in which one of the parties is the data subject, is concluded or performed;
    3. the Company is obliged to process the Personal Data by law;
    4. the Personal Data must be processed for the purpose of a legitimate interest pursued by the Company or a third party to which the personal data are provided, and if interests of the data subject are not more important.
  • Personal Data are updated on a regular basis;
  • Personal Data are stored for no longer than what is required by the stated purposes of data processing;
  • Personal Data are processed only by those employees who are entitled to do so;
  • All information about the Personal Data processed is confidential.

 

  1. Nature of Information Collected

Depending on the nature of supplied goods/provided services, the Company may collect the following data of the Customer:

  • main Customer information: name, surname, personal identification number, address, copy (if provided) and data of a personal identification document, phone number, e-mail address;
  • information about the goods purchased by the Customer/services provided to the Customer: information about the selected/provided services and the duration of their use, information related to the assessment of quality of goods/services, information about the return of goods, after-sales service, etc., data on the Customer's insolvency risk assessment;
  • information about payments for goods/services: data of invoices submitted to the Customer, data on payments of the Customers or other parties, information on debt management (including the transfer of data to third parties);
  • information about the Customer’s consent to direct marketing: information about the Customer’s consent/non-consent to the receipt of promotional information (news, programme offers, promotions, etc.), the participation in opinion polls, the use of data, the provision of the Customer’s data to third parties, as well as – about the consent to the insolvency risk assessment;
  • communication and Customer service information: data about browsing on the Company's web pages and self-service websites (collected using cookies and similar technologies); recordings of telephone conversations with the Company's representatives, information from correspondence with the Company (via self-service, e-mail, applications, etc.), the Customer's enquiries and the Company’s responses regarding issues that need to be addressed;
  • other data: information of prize winners, information about survey participants, newsletter subscribers.
  1. Purposes of Data Processing

The Company uses the collected data to deliver its services/products to you, as well as to provide assistance, send messages, offers and information about promotions, to protect its rights and interests and the rights and interests of third parties, to comply with the applicable legislation.

Purposes of information processing:

  • conclusion and performance of a contract (delivery of goods/services), their quality assurance, Customer service, and provision of information;
  • direct marketing and general informing about new products and services (unless you have opted out of such messages);
  • accounting;
  • fulfilment of legal obligations, e.g. debt management and recovery;
  • administration and improvement of the Company's website, keeping it secure and ensuring that the content is presented in your device in the most efficient way;
  • fulfilment of legal obligations provided for in the legislation;
  • other purposes for which the Company has the right to process your Personal Data when you express your consent, when the data must be processed for the Company's legitimate interest, or when the Company is obliged to process the data by the relevant legislation. We may also process the Personal Data for another purpose, provided that we have obtained the data subject’s consent to such processing or we have the right to process the data on the ground of a legitimate interest.
  1. Ways of Data Collection

We collect information about you in the following ways:

  • When you provide information to the Company by yourself (e.g. by filling in the Company’s applications, contracts and/or other documents (including through our partners), on our website electronically, by submitting enquiries, by post, e-mail, phone, during direct video chats, by other means of communication);
  • When we receive information about you from third parties with which we cooperate (e.g. partners, state institutions, etc.).
  1. Duration of Data Processing

The Company processes the Personal Data only for as long as necessary to achieve and implement the purposes specified herein, taking into account the nature of the goods/services delivered to the Customers and of contracts concluded with them, except for cases where a longer period of storage of the Personal Data and related documents is set or permitted under the applicable regulatory legal acts and is necessary (e.g. mandatory document storage periods, the period of limitation, etc.).

  1. Transfer of Data

In order to achieve the purposes set in the Privacy Policy, the Company may transfer your data to the following data recipients:

  • Data processors which provide services and process your data on behalf, in the interests of and on commission from the Company (e.g. IT service providers, auditors, consultants, etc.). Data processors process your Personal Data only in accordance with explicitly specified instructions, undertaking to ensure the proper protection, confidentiality of the Personal Data received from the Company for processing, and organisational and technical measures meeting security requirements, as more specifically discussed in data processing contracts concluded between the Company and subcontractors.
  • Entities engaged in administration of debts and the database of debtors. The data are submitted only within the scope and under the conditions permitted by the legislation.
  • Entities entitled to receive information in accordance with the requirements of the legislation (e.g. courts, state and municipal institutions, etc.), only to the extent necessary for the proper implementation of the existing legislation.
  • Companies of ACME Grupė when this is necessary for ensuring the proper provision of services.
  • Other third parties on another legitimate ground or upon your consent, which may be obtained for a specific case. 

Data processors to which the Company transfers your personal data may be established outside the Republic of Lithuania, the European Union or the European Economic Area. The data to such processors are transferred only if permitted by the requirements of the legislation and only by taking all necessary measures to ensure the protection of your privacy.

  1. What rights do you have?

The Customer has the following rights:

  • to contact us and discuss emerging issues regarding the processing of the Personal Data by the Company;
  • to get confirmation from the Company as to whether the Personal Data relating to him/her are processed, and if such Personal Data are processed, the Customer has the right to access the processed Personal Data and the information related to them;
  • to get, in writing or in a commonly used electronic form, the Personal Data provided by himself/herself, which are processed on the basis of his/her consent or performance of a contract, and, if possible, to request the transfer of such data to another service provider;
  • to request rectification of his/her Personal Data if the data are inaccurate, or completion of incomplete data;
  • to request erasure of his/her, him/her being the Company's Customer, Personal Data processed with the Customer's consent if the Customer withdraws the respective consent. This right does not apply if the Customer's Personal Data requested to be erased are also processed on another legal ground such as the processing necessary for the performance of a contract or being the fulfilment of an obligation in accordance with the applicable legislation;
  • to request restriction of the processing of his/her Personal Data, e.g. for a period enabling the Company to analyse whether the Customer has the right to request erasure of his/her Personal Data and whether it is practically possible to do so;
  • to not consent to the processing of the Customer's Personal Data for the purposes of legitimate interests of the Company or third parties if the ground for processing of the Personal Data is legitimate interests, as well as in the case where the Personal Data are processed for direct marketing purposes, including profiling carried out for this purpose;
  • to not consent to being subject to a fully automated decision, including profiling, if such decision making has legal consequences or a similar significant effect on the Customer. This right does not apply where such decision making is necessary for the purposes of concluding or performing a contract with the Customer, is permitted under the applicable legislation, or the Customer has given an explicit consent to this;
  • to withdraw his/her consent to the processing of Personal Data.

The Customer shall exercise his/her rights by submitting a specific request using the contacts specified herein. Information related to the exercise of the Customers’ rights is provided to the Customers free of charge. The Company shall, no later than within 1 month of receipt of the request, provide the Customer with information on actions taken on the Customer's request regarding the exercise of his/her rights, or indicate the reasons for not taking action.

The period for provision of the requested information may be extended by 2 further months where necessary, taking into account the complexity and number of the requests. Where the Customer makes the request by electronic form means, the information is provided to him/her by electronic means as well.

The examination of the received request of the Customer regarding the exercise of rights may be refused or an appropriate fee may be charged for it if the request is manifestly unfounded or excessive, as well as in other cases specified in regulatory acts.

If the Customer believes that his/her Personal Data are processed in violation of his/her rights and legitimate interests under the applicable legislation, the Customer has the right to lodge a complaint with the State Data Protection Inspectorate regarding the processing of Personal Data.

  1. Updates to the Privacy Policy

Should the need arise, the Privacy Policy may be updated – prior versions of this Privacy Policy are kept in an archive for your review, and in the event of amendments to the Privacy Policy – the information will be published at www.acme.eu/privatumopolitika

The Company’s website and products may contain links to third-party websites. These third-party websites apply their own privacy policies. If you visit these websites, you will be subject to their respective policies.

Az Öntől kapott adatok kezelése során minden erőfeszítést megteszünk annak érdekében, hogy biztosítsuk azok biztonságát, és azt, hogy a bevezetett intézkedések magas szintű technikai és szervezési követelményeknek feleljenek meg. Joga van ahhoz, hogy hozzáférjen az adataihoz, hogy indoklás nélkül megtagadja a személyes adatai közvetlen üzletszerzési célokból történő kezeléséhez való hozzájárulást, valamint hogy írásban kérje a helytelen, hiányos vagy pontatlan adatok helyesbítését. Az Ön jogait sértő személyesadat-kezeléssel összefüggésben panaszt tehet az Állami Adatvédelmi Felügyeletnél.
